Reconstruction at risk: do we need changes in construction policy?

Project Objective: To analyse regulatory barriers in Ukraine’s construction sector that restrict companies’ participation in public procurement for recovery and reconstruction projects and are not aligned with EU legislation.

As part of the project, a comprehensive assessment was conducted of the existing regulatory framework governing Ukraine’s construction sector and its impact on companies’ access to the public procurement market for recovery and reconstruction. The research included in-depth interviews with representatives of construction companies and public authorities, as well as an analysis of findings from previous monitoring studies. Particular attention was paid to assessing the alignment of Ukrainian legislation with the European Union acquis on the free movement of services. Urban planning documentation, however, was outside the scope of the study.

Based on the findings, an analytical report was prepared with recommendations for removing regulatory barriers, improving the regulatory framework, and strengthening competition in public procurement. The report’s findings served as the basis for a public discussion involving representatives of government, the business community, and experts to develop proposals for improving Ukraine’s construction policy and bringing it closer into line with EU requirements.
